Pending Home Sales Surprisingly Climb despite Foreclosure Stoppage

It was a surprise for the Real Estate and housing market. Pending sales in the US of existing homes rose in October. It came despite rising concerns that current problems in mortgage banks’ foreclosure processes might affect market activity.

According to the National Association of Realtors’ (NAR) Pending Home Sales Index, pending sales of existing US homes rose to 89.3 in October, up by 10.4% from 80.9 recorded in September. It was a surprise, because most market analysts expected for about 0.5% decline.

However, the index of pending home sales remains below the cyclical peak record of 112.4, which was recorded in October last year. In October 2009, the sales figure was boosted by a tax credit issued by the federal government to persuade first-time buyers to purchase homes.

NAR said it was pleased to see a double-digit and strong gain in sales of existing homes. However, it added that the market activity should continue to show signs of improvement for the market to actually reach healthier and more sustainable levels.

It could be recalled that a number of major US mortgage banks temporarily stopped their foreclosure activities in September to October this year. The action was a result of allegations from numerous actual borrowers that the lenders mishandled foreclosure processes and evicted many homeowners from their homes without due process and necessary legal review.

Such allegations also unveiled the so-called ‘robo-signers’ and ‘dual tracks’ that are allegedly practiced by mortgage servicers. ‘Robo-signers’ are supposedly enabling the banks to process hundreds of foreclosure documents within just one day. ‘Dual tracks’ is the practice of foreclosing homes even if the homeowners are still in the process of negotiations for possible loan assistance programs from banks.

Mortgage lenders’ temporary halting of their foreclosure activities has posed noticeable impacts on many market figures and data in the recent weeks. Usually, the action dragged down home sales and foreclosure volumes. It came as a surprise that pending sales of already existing homes rose and defied the trend.

Purchase Mortgage Demand Rises to Record Levels

As a sign that homebuyers are getting more confident about their financial conditions, demand for purchase home loans rose in the week ending November 19. Loan applications for home purchases jumped 14.4% in the week compared to the previous week. This is according to the Weekly Mortgage Applications Survey released by the Mortgage Bankers Association (MBA)

The increase in purchase loan demand was at its peak since the demand in the May 7 week, which followed the April 30 expiration of government tax credit for home purchases. The comparative rise in loan purchase demand was attributed to absence of any adjustment in time for the holiday and the inclusion of the Veterans Day commemoration in the preceding week.

However, the survey also revealed that mortgage refinance applications fell in the same week by 1% compared to the volume in the preceding week. It was also the lowest level for such loan since June, following rise in rates of 30-year fixed-rate home loans.

Market analysts asserted that the stronger home purchase loan applications in the week were in line with other data, which suggest that most consumers are now getting more confident when it comes to their respective financial conditions. However, such demand for home purchase loans remain lower compared to year-ago figures.

In comparison, applications for same home purchase loans in the same period last year was 7.4% higher. In the week ending November 19 this year, loan applications for refinancing existing loans comprise up to 78.6% of all home loan applications. It was down from 80.3% in the previous week.

Meanwhile, contract interest rate average for 30-year fixed-rate home loans rose to 4.50% that week from 4.46%. That was a record average rate in the same survey since the week that ended September 3. For 15-year fixed-rate home loans, the contract interest rate fell to 3.83% from 3.87%. Analysts read the figure as an almost unchanged rate.

Some market observers noted that the rise in weekly demand for home purchasing loans was interesting. According to them, it was because such demand has been falling since September, when major home lenders acted to increase restrictions on home loans following alleged anomalies in foreclosure processes.

Home lenders have been accused of mishandling foreclosures. Investigations are still conducted to shed more light to the issue. Proposed Bill Intends to Require Court Approval before Foreclosures in Massachusetts

Massachusetts Secretary of State William F. Galvin has announced plans to submit a legislative proposal in January to force mortgage banks across the state to obtain court approval before repossessing homes as part of foreclosure. The proposed bill is logically intended to give homeowners more protection and at the same time address specific concerns on how foreclosure procedures are actually conducted.

Secretary Galvin said the bill is a revival of a proposal that was rejected by state legislators in 2008. The aborted bill was turned down due to questions regarding the validity of foreclosed properties’ titles. At that time, issues of validity of titles were considered as major threats to the Real Estate market across the state.

Currently, Massachusetts is among 27 states in the country where foreclosures are not required to be reviewed legally. In reaction to the proposed bill, several banks and Real Estate lawyers agree that mandating such judicial approvals would only create another layer of bureaucracy, which would certainly result to delayed foreclosures and eventually to a slower recovery of the housing market.

It should be noted that foreclosure procedures usually take longer in states where courts need to sign off foreclosure documents first. According to the Federal National Mortgage Association (Fannie Mae), it could take 180 days or more for a foreclosure to be completed in states that require judicial oversights on such proceedings. In comparison, in Massachusetts and 26 other states, it only takes about 90 days for completion of foreclosures to take place.

In defense of his stand, Secretary Galvin said he is confident that a court oversight would effectively help in resolution of uncertainties concerning titles, which have already put numerous properties in limbo. He added that the process could be accelerated and finality could be ensured.

In support of the proposed bill, lawyer Geoff Walsh of the Boston-based National Consumer Law Center said longer timetables for foreclosure processes would provide homeowners and even banks with more time to explore other options and solutions. He added that more communication between the parties would be more beneficial in the long run. It would even be cost-effective to the lenders as the foreclosures would be hassle-free and final.

The proposed bill comes amid rising concerns about foreclosure practices of mortgage servicers across the country. Regulators and state attorneys are now looking at some consumers’ allegations that mortgage banks process foreclosures hastily and without proper legal review.

Home Prices Decline Faster in More Metro Areas

Home prices continue to drop in most metropolitan cities across the US. The trend is logically linked to the rising number of foreclosed homes coupled with consumers’ disinterest in purchasing properties, probably because of the continuing aftermath of the recent financial downturn.

Early this week, Standard & Poor’s released its index of home prices across major US cities. Data from the S&P/Case-Shiller 20-City Index showed that home prices in major US urban centers declined another 0.7% in September from August. It was the second consecutive drop of the index. It also revealed that house costs fell in 18 out of 20 cities covered by the index.

Analysts from Standard & Poor’s attributed the price decrease to a high rate of unemployment and more stringent requirements by lenders who provide credit. They added that most consumers showed fear in losing their own homes; thus, mortgage applications dipped. The same analysts believe that housing markets would not possibly show improvements until the volume of foreclosures diminish and employment rate picks up.

Home prices in Tampa, Florida dropped 0.8% in September from August, the lowest level in the city since 2003. The median price of available homes stood at $115,700 in the third quarter ending September. Market observers noted that home buyers in the city are on a spree as they receive more than 50% of discounts in prices.

In Miami, home prices fell 1.2%. It is estimated that as of the third quarter, a home out of every 41 homes received a foreclosure notice. In the nearby city of Phoenix, prices dropped 1.5% and foreclosure rate remained high: one in every 44 households.

Las Vegas showed signs of early stabilization. For the second straight month, house prices in the city rose albeit in a modest 0.1%. Analysts said buyers are apparently taking advantage of falling prices, which are currently up to 50% below peak prices in the city in 2006. However, the city has the worst rate of foreclosure in the country. One household out of every 25 received foreclosure notice in September.

Washington also posted increased home prices over the month. Market observers noted that the US capital city had smaller foreclosure rate in the period. Economists emphasized that the city posted one of the most improving economies. The city had the biggest gain in employment rate in September, which, according to analysts, could have prompted consumers to show interest in buying homes.

Government Regulators Caution Banks on Foreclosure Documentation

Banks are experiencing backlogs in processing evictions and foreclosed home sales due to poor documentation. They have also been accused of using “robo-signers” to sign multitudes of foreclosure papers without the benefit of proper legal reviews. The fiasco has earned the ire of the public who are still angry at banks for receiving billions in taxpayer money to tide them over in the recent financial crisis.

Probes have been initiated by attorneys general across the country on the foreclosure activities of banks and to convince them to exert more efforts in helping borrowers hold on to their homes. Scheduled to meet with members of a multi-state group conducting the probe in November 2010 are the executives from Wells Fargo Corp., Citigroup Inc. and Ally Financial’s GMAC Mortgage.

The House of Representatives subcommittee of Financial Services has also scheduled a hearing on the subject and invited executives from the three banks and from JP Morgan and Bank of America. They also invited bank regulators to the hearing.

Major banking institutions and other mortgage lenders have admitted to the documentation problems they are experiencing but reassured probers that they have taken measures to improve the procedures. They also reassured government regulators of the accuracy of the foreclosures they have enforced in recent months.

Elizabeth Duke and John Walsh, Federal Reserve Governor and acting comptroller of the currency respectively, have said that they will release the findings of the probe they have undertaken in the early part of 2011. They also said that bank regulators have threatened banks of several enforcement actions available to them should banks fail to clean up their acts.

Bank regulators are likewise looking into the capability of banks to absorb the risk for the so-called “put-back” situation. This risk can stem from investor accusations that banks and other lenders have misrepresented loans underpinning demand repayment and mortgage securities.
