Land Eyed by Target Falls to Foreclosure

A 19-acre property that was eyed last year by discount retailer Target is now undergoing foreclosure. The land is located at La Madrona Drive, Scotts Valley, California. The property is scheduled to be auctioned starting December 28.

The property was used as a security for a $4.65 million loan obtained by its two owners, Adeline Investments Inc and Title Two Investment Corp, in March 2007 from East West Bank. The lender disclosed that the borrowers did not make the agreed upon payment due in December 2009. The companies also failed to make payments on subsequent installments. The default notice was filed last February.

According to the sale notice released last week, the loan amount is now worth $5.653 million. The county assessor’s office has assessed the land at about $4.86 million. Property taxes were at $140,237 in the last six months to December 10. The original owner of the property was forced to pay $380,619 worth of delinquent land taxes.

Scotts Valley City Management said it has not heard from the two companies for quite some time. The office added that it has no idea what the financial situations of the two are, as of the moment.

Adeline Investments is headed by David Choo, a Nevada-based investor who is prominent in San Francisco as a Real Estate buyer. According to documents, Mr. Choo’s California Mortgage and Realty Fund II LLC have filed for bankruptcy court protection and have announced plans to reorganize last March 2009. Sources say the company has incurred combined losses of up to $22 million from then on.

Mr. Choo was also the registered owner of the other company, Title Two, until July 12. After that, the business was acquired by Frontier Ridge Global Fund, a New York-based hedge fund. Title Two has also defaulted in a separate loan.

The land situated in La Madrona Drive was held as collateral, together with another property at 524 Howard Street in San Francisco, for Adeline Investment and Title Two’s loan. As mentioned, the lot was eyed by Target as a possible site of its new location in the middle of 2009. But the retailer had a dispute with Title Two.

Target instead bought a vacant building, Gottschalks, within the premises of the Capitola Mall. Meanwhile, the Scotts Valley land has remained undeveloped.

Home Prices in the US Forecast to Decline Further by 10%

Overall US home prices are set to decline further by an additional 10%. This is the forecast of Greg Lippman, an ex-trader at Deutsche Bank AG who, in the past, had gained a reputation for making bets against existing subprime mortgage securities.

Mr. Lippman emphasized that purchasers of mortgage securities anticipate a decline, but most investors in other markets do not acknowledge a potential decline. Consequently, according to him, mortgage debt remains cheaper this year compared to high-risk and high-yield corporate bonds. He added that the home loans market would do fine if home prices drop 10%, but broader markets may not be able to cope up.

Meanwhile, an index measuring pending sales of homes rose to a record-high of 10% last October. It dropped 1.8% in September, according to data released by the National Association of Realtors. The rise in home sales was much better than market expectations.

The index of credit-default swaps by the Markit ABX has jumped by about 33% so far this year. The index is tied to about 20 subprime-loan bonds that are rated AAA during the time it was created in 2006. According to the Markit Group Ltd, the increase generally indicates lower or less pessimism regarding the worth of current subprime debt.

Analysts note that while a possible and further drop in home prices may hurt the industry as a whole, it could be most welcomed on the part of homebuyers. Foreclosed homes are more likely to further attract attention. That is because such foreclosed properties are typically lower priced when out up for sale in the market. How Entitlement Killed Unemployment

When a person becomes unemployed and is allowed benefits they are required to make two job contacts per week to maintain their benefits.  At one end of the spectrum there are people pushing as hard as they can to find a job.  They are visiting prospective employers, sending out resumes, networking and volunteering to increase their exposure to those that might be able to direct them to an opportunity.  In my world, these people seem to be rare.  Maybe not because there are fewer of them but because they don’t stay unemployed long.  Some do, of course, but many are off to the next opportunity.


Then there is the other extreme.  These are the people that see unemployment as an entitlement.  Since it was made available it must be theirs to claim.  These are the people that walk into a business, apply, and quickly leave with no actual interest in employment.  If a business owner or manager asks to visit with the applicant they will share they are only making the contact to maintain their unemployment.


A number of people fit in the middle.  They are adjusting to the lower income and actually consider it a half paid vacation.  They are a bit like the grasshopper in the old story of The Grasshopper and the Ant.  When the end of their employment comes close to an end the motivation to acquire a job will start.


Please don’t assume that any specific item here is to dishonor anyone truly trying to gain employment.  That isn’t the goal.  The point is to recognize that there are people all along the scale.  My goal is to show that components of our current system need to be adjusted to recognize realities.  Components include the attitude and choices of employers, employees, and the government.


It is time to take a look at a few facts about employers, employees and government.  This is just one man’s perspective so let me know if you feel something here is incorrect.


First the government.  First and foremost government is directed by our elected officials.  Every area or department of government then does what it thinks it should from there.  Our elected officials want to be elected.  They merge the emotional wishes of their constituents with their own personal perspective.  They take this romantic soup and create the laws and the basic outline of systems associated that departments and agencies use.


Second the employee.  Speaking from my recently new experience with the Employer’s Council of Iowa, the employee is the “client”, “customer,” and “member” of the state employment agency.  That puts the common citizen in a particularly odd and powerful position.  The voter hires the government and then tells the government what he/she wants.  Our basically immoral mindset motivates us to care more about “What’s in it for me?” and less about “How or who will pay for this?”  The elected official says, “What can I do for you?”  The employee says, “Give me more for less.  I’m entitled to it.”


Lastly, the employer. The employer is the odd one out.  Since the number of employers is far less than the number of employees the voice of the employer is much smaller.  In effect the employee and the government merge efforts to push the employer to execute as directed.  It is a lot like Cinderella and her evil step mother and step sisters.  To run a business in the United States the business owner must accept this relationship of government, employees and people.  Some will argue but it is hard to understand if you haven’t lived it.  I’m sure it is a little like childbirth.  Knowing my wife of 20+ years as I do and watching her deliver our children as I did, I know that even loving and caring for her as much as I do there is no way I could know either the pain or the depth of emotion felt by a mother.  The same goes for the business.  It’s often been felt that the business is the child of the entrepreneur much as the child is of the mother.


With the landscape understood, I’ll cut to the chase.  Iowa is pumping tens of millions of dollars into making sure employers aren’t hiring people as independent contractors when they should be employees.  The main reason is that hiring people as independent contractors avoids paying unemployment taxes.  The government provided wonderful benefits and extended them for a very long time draining resources.  Now with resources drained they are spending, in Iowa’s case, over $50,000,000 to audit this one are of operations alone in an effort to lower losses and improve revenues. 


I don’t condone skirting the law to save money.  It is not right and shouldn’t be tolerated.  What is most painful is to watch the government threaten, audit and penalize businesses (which ultimately are only made up of people) while they only require two applications a week be completed and there is no accountability for those who refuse work or interviews.  Our government and agencies trip over themselves to serve the client, customer, member then seem to turn a blind eye to improper and in my eyes immoral and illegal behavior.  Lastly, why not audit the claimant?  Did they make a reasonable effort?  Were they interested?  Did they wear shoes to apply?  Yes, indeed I’ve personally seen multiple people over the years come in to apply and not wear shoes.  As a matter of fact I’ve seen them come in using vulgar language, with it printed on their t-shirt, un-bathed, and most often simply sharing that they aren’t interested in a job, they are just making their two contacts required.


Another cut making the wound deeper is that employers are scared to death of regulatory departments.  In most cases a business won’t turn and fight unless it is life or death.  Once a regulatory misstep is so great that a business may fail because of it the business has nothing else to lose so fights back.  If it isn’t that bad they try to duck lower than their competitor and hope the competitor takes the bullet.


As a community of citizens we’ve been distracted from the broader view of government and redirected to isolated problems individually that don’t considering the whole.


I’ve lost a great deal of hope in our country.  Why?  Because hope is empty and distracting without a method and we certainly aren’t interested in holistic methods.  We’re interested in today’s comforts much more than tomorrow’s meals.  Our system is to offload responsibility to the government.  Then we complain and wrongly claim, “There is nothing I can do about it.”


It looks like a bunch of people in a boat floating in the middle of an ocean.  The boat starts to leak but rather than do the hard work of fixing a problem in a precarious situation the passengers argue about whose fault it is and why it is someone else’s fault.  The water continues to come in and when the boat gets desperately full they argue about who will bail, why, and for how long losing site of the fact the leak needs to be fixed.  The boat is perilously unstable and then the storm blows.  In this case it looks like they will drown before they choose to fix the leaks and bail like hell.  Bail doesn’t mean dollars.  Bail is a verb indicating work in this situation.


Answer these questions for yourself.  Why are other countries starting to advertise in the United States stating they are a better place to live, own and operate a business than the United States?  If that is true, what will keep businesses here?  Especially international businesses?  Why, when someone is unemployed and drawing benefits are they only required to make two contacts in a seven day period?  Why, when claims are so high and resources drained so low is the government not also looking at the claimants to investigate fraud?  Why, at the same time, are so many companies, even in these terrible economic times saying they can’t find good people?  Too many grasshoppers and not enough ants.


Ultimately our troubles are of our own making.  We individually are not doing enough and are not feeling responsible enough.  In the past people made such comments as, “Someday we will have to pay.”  We may not see it but today we are paying and we will continue to pay until such time as we understand the truth of what is happening and demand of both ourselves and others the hard work and higher standards necessary.

Habitat for Humanity Celebrates Resale of First Home under Foreclosure Program

Habitat for Humanity last week celebrated the sale of its first home that was put up for sale under the foreclosure-fix program Neighborhood Stabilization Program in Virginia. The program is sponsored by no less than the US Department of Housing and Urban Development. It aims to fund and oversee purchase of foreclosed homes across neighborhoods that have at least a 20% rate of foreclosure.

The first home sold by Habitat for Humanity under the program was located at 1357 Rome Street in Petersburg, Virginia. The property was acquired earlier in the year for $41,000 by Tri-Cities Habitat for Humanity. Since its acquisition, the home was aggressively renovated before it was finally resold through the joint effort.

Habitat for Humanity has already purchased up to 14 other foreclosed homes in Petersburg. It is now in the process of finding families that would qualify for the federal government’s Neighborhood Stabilization Program. This program is an effort to openly and effectively aid the weak housing market through acquiring foreclosed and abandoned homes.

The main qualifications for the Neighborhood Stabilization Program include: family income that is between 20% and 60% of the median income in the city, an outstanding credit score of about 600 or higher, participation in Virginia Housing Development Authority (VHDA) home ownership class, at least 300 accumulated hours of volunteer work for any Habitat Project community service work, and ability to take a mortgage of $350 per month.

For its part, Habitat for Humanity is a non-government, non-profit, and international organization that aims to build decent, simple, and affordable homes for needy families. The organization is based in Americus, Georgia, and has five area offices globally, including the one covering US and Canada.

Habitat for Humanity seeks elimination of poverty housing and widespread homelessness around the world. It also aims to make decent shelters part of social conscience and action. The organization builds its homes through volunteer work and then sells those to selected families without any profit.

The organization has recently broke ground for a new home-building project in the busy Rome Street. The project’s new homes are expected to be completed by April next year. Those homes are set to be sold to qualified families at more reasonable and no-profit costs by the end of 2011.

·  Use Google Alerts to find posts of interest throughout the web.  I set up Google Alerts for Social Media and ROI.  I get a digest daily.  I scan those articles, Tweet some, comment on some and use others in my own blog posts.  I spend no more than an hour a day doing that.

·  Work each social media site at a given time and a given day throughout the week.  I work LinkedIn twice a week.  I go to Facebook daily for 15 minutes.

·  Use a company like Hubspot (http://hubspot.com/) to identify Tweets, blog posts and other web-related content that are relevant to your keywords.  Spend about 30 minutes daily scanning those items and joining the conversation.

·  Write blog posts at a given time weekly and spread out their scheduled publication.  Blog no less than twice weekly. 

·  If you get too absorbed in the social media, once you set a time limit, set your timer.  Stop when that timer sounds.

It’s not all fun.  It’s work and then it’s fun.

NAR: Commercial Property Vacancies Set to Decrease

The National Association of Realtors (NAR) is confident that vacancy rates of commercial Real Estate in the US have already reached its peak and would soon fall. The realty group expects vacancy rate for existing office spaces to rise to 16.7% in the fourth quarter of this year. It is also optimistic that the rate would gradually drop to 16.4% on the fourth quarter of 2011.

The group’s index that measures commercial Real Estate conditions climbed 1.6 percentage points in the third quarter to 42.6. That is still way below the equilibrium level of 100, which represents balance in the marketplace. It could be recalled that the last time equilibrium was reached in the commercial Real Estate market was in 2007 (third quarter). The index remained weak, but it marked a fourth consecutive quarterly rise.

The group also expects rental fees in the commercial property market to continue declining. This is because the vacancy rates remain and is expected to remain high despite slow improvements. High vacancy rates equate to falling rental fees, in accordance to law of supply and demand.

Analysts from NAR emphasized that their outlook for industrial and office markets remain moderate. They expect vacancy rates to modestly decline in the coming months until the end of next year. However, the retail sector, according to them, is expected to hold fairly steady.

Market observers note that a sluggish commercial property market has been dragging down overall economic growth in the last 2.5 years. They added that the weak commercial Real Estate market has also been affecting the gross domestic product figures in nine out of the last 10 quarters.
