Lawmakers Look at Problems in Home Loan Servicing Practices
The committee has summoned several regulators from the two industry watchdogs. Chairman Sheila Bair of the US Federal Deposit Insurance Corp and Governor Daniel Tarullo of the US Federal Reserve have been asked to appear in the hearing to give updates on their own investigations.
The regulators are expected to be put in hot seats, because several lawmakers are suspicious and disappointed about how they oversee industry foreclosures. The two watchdog representatives, for their part, are expected to discuss how the documentation problems serve as threats to mortgage lending and to the housing market recovery as a whole.

The strongest companies in the US economy have been these US multinationals and those U.S. affiliates who are performing similarly in terms of outsourcing and are headliners on that list of corporate businesses that have consistently accounted for the vast majority of acceleration in U.S. productivity growth after 1995 and this acceleration has, in turn, formed the very bedrock of increased standards of living for all Americans, creating 27.5 million high-paying positions in 2007. In order to climb out of the recession, we need to create millions of the kinds of jobs that U.S. companies tend to create.

Fannie Mae Suspends Foreclosure Evictions in Time for the Holidays
The mortgage company observes a tradition of halting foreclosure processes every year during the Christmas holiday season. Fannie Mae formally made its announcement for the holiday foreclosure suspension a week after the Federal Home Loan Mortgage Corporation or Freddie Mac disclosed its own plan to do the same.

In other cases, dual tracking was committed. In the process, a lender implements and finalizes a foreclosure even if the law states that a borrower should be given opportunities and time to negotiate terms to avoid foreclosure.
The issue prompted the Senate Banking Committee to conduct a series of hearing about the problem. Regulators, state attorneys general, and bank representatives were summoned for the hearing. Fannie Mae and Freddie Mac were also invited to provide their testimonies.

NAR Home Sales Index Rises in October
The National Association of Realtors index of sales contracts jumped 10.4% in October. Such contract signings rose in all regions across the US except in the West. The index covered purchase contracts that involve previously occupied, including foreclosed homes, which are up for sale.
The gain in home sales contracts in October was about 18.3% higher than the index in June, which was the record lowest level for the entire decade. NAR started tracking such signed home sale contracts in 2001. The October increase was still 20.5% lower compared to the index in October 2009. The record highest level of the index was in May 2006, which came prior to the historic collapse of the national housing market.
The increase came somehow as a surprise. Most economists had expected a decline in such home contract agreements. They underlined the numerous and grievous problems that the housing industry has been facing.
It should also be noted that last year, more homebuyers got into contracts to buy existing or already occupied homes. That is because at the same month in 2009, more homebuyers rushed to enjoy a buying spree in the market to take advantage of the federal governments tax credit offers.
The US government last year offered home-buying tax breaks to consumers who were at that time considering acquiring homes. The aim was logically and obviously to help the housing market rebound through bolstered sales. The tax credit was originally set for a November expiration, but it was extended to April 2010.

Many homeowners attempting to do a short sale were challenged with the fact that the bank would not give them a full release of liability. If the bank decided to collect on the balance of the note, the only solution for the homeowner would be to file chapter 7 bankruptcy as a last resort. Many homeowners chose the other option, which would be foreclosure. Under the laws under the state of California, once the bank foreclosed there would not be any liability. The banks usually ended up with tens of thousands of dollars less when they foreclosed on the property, compared to doing a short sale. On October 1, 2010 the governor signed into law SB931 or the Anti-Deficiency Bill for sales completed after January 1, 2011 for first trust deeds only. This bill will protect the short sale seller from the bank on the first trust deed from proceeding with any collection action after the sale. All first trust deeds will be protected even when equity was taken out of the house in a refinance. The bill does not offer any protection for second trust deeds. Most homeowners who use subprime lending in the peak of the market had a first and second combination. This law does not protect the homeowner if the lender can prove fraud.
Many people are questioning why this bill was so limited in scope, as to not also providing protection for second trust deeds. Homeowners who have already closed on a short sale without a full release of liability from the lender would like to see this bill retroactive. It is a step in the right direction, but does not go far enough.
