Lawmakers Look at Problems in Home Loan Servicing Practices

The US Senate Banking Committee is set to hold a hearing this week to look at the problems that hound the mortgage service industry. Legislators intend to probe on allegations that home loan lenders used ‘robo-signers’ in signing numerous foreclosure documents in as fast as a day without due and necessary legal review.

The committee has summoned several regulators from the two industry watchdogs. Chairman Sheila Bair of the US Federal Deposit Insurance Corp and Governor Daniel Tarullo of the US Federal Reserve have been asked to appear in the hearing to give updates on their own investigations.

The regulators are expected to be put in hot seats, because several lawmakers are suspicious and disappointed about how they oversee industry foreclosures. The two watchdog representatives, for their part, are expected to discuss how the documentation problems serve as threats to mortgage lending and to the housing market recovery as a whole.

Federal bank regulators, together with 50 state attorneys general, are investigating JP Morgan, Bank of America, and several other mortgage providers amid numerous charges and complaints from their customers about the supposedly mishandling of foreclosure procedures. Most of the lenders temporarily stopped their foreclosure proceedings to re-assess and review their foreclosure and documentation practices. However, most of them have also resumed foreclosures, though in a slower pace.

Regulators have earned flaks from countless critics for allegedly not noticing those widespread industry flaws. Such criticisms and the supposed anomalies have instantly reignited public anger towards banks, which have mostly received billions of dollars in financial aid during the height of the recent financial crisis.

It truly is this simple: an increase in the employment of offshore outsourcing business strategies will increase domestic employment and domestic investments. History and the evidence that history provides us clearly demonstrates that it is the US-based companies that outsource their non-core competencies that are creating these jobs.

The strongest companies in the US economy have been these US multinationals and those U.S. affiliates who are performing similarly in terms of outsourcing and are headliners on that list of corporate businesses that have consistently accounted for the vast majority of acceleration in U.S. productivity growth after 1995 and this acceleration has, in turn, formed the very bedrock of increased standards of living for all Americans, creating 27.5 million high-paying positions in 2007. In order to climb out of the recession, we need to create millions of the kinds of jobs that U.S. companies tend to create.

Following are some other compelling facts related to US Businesses who strategically outsource offshore:

• the average compensation per worker in these savvy global US firms in 2007 was $65,248 accounting for about 20% above the average for all other US jobs;


• they undertook $665.5 billion in capital investment, constituting a full 40.6% of all private-sector non-residential investment;


• they exported $731 billion in goods, 62.7% of all U.S. goods exports; and


• they conducted $240.2 billion in research and development, a remarkable 89.2% of all U.S. private-sector research and development, the vast majority of which was spent in the US

In other words, if the substantial profits for stockholders, partners & investors is not enough to convince US Businesses of the value of offshore outsourcing and, if a more focused performance on core competencies and non-core competencies are insufficient to convince US Businesses of the value of offshore outsourcing, then certainly US businesses can credibly boast that US companies who outsource their non-core competencies are not only maximizing their business proficiencies but they are conducting themselves as good global citizens, creating many badly needed jobs for their global neighbors while comfortably demonstrating that they are also excellent domestic US Corporate Citizens, enhancing the US job market and domestic employment statistics.

Fannie Mae Suspends Foreclosure Evictions in Time for the Holidays

The Federal National Mortgage Association or Fannie Mae has formally announced the temporary suspension of all its foreclosure evictions for two weeks. The government-sponsored secondary mortgage servicer said it would implement a ban in evicting families from foreclosed homes from December 20 until January 3 of the coming New Year.

The mortgage company observes a tradition of halting foreclosure processes every year during the Christmas holiday season. Fannie Mae formally made its announcement for the holiday foreclosure suspension a week after the Federal Home Loan Mortgage Corporation or Freddie Mac disclosed its own plan to do the same.

Fannie Mae presently holds a delinquency rate of about 4.56% of its mortgage portfolio. As of October this year, the company has a combined loan amount of $798 billion. It is actively buying mortgages from banks to make sure those lenders would have replenished resources to provide more loans to more needy borrowers. In turn, Fannie Mae securitizes the mortgages it buys as mortgage-backed securities.

In an emailed statement to media, Fannie Mae said the temporary foreclosure halt is in line with its practice in the past years of not evicting families from their homes during the season. Several private lenders also make similar temporary bans to give way to the holiday celebrations.

Fannie Mae and Freddie Mac have recently ordered their property agents to resume selling foreclosed homes. The two companies, along with most mortgage lenders, decided to temporary freeze their foreclosure activities after a foreclosure documentation scandal erupted in September.

Numerous homeowners and mortgage borrowers have complained that some lenders illegally evicted them from their homes. Investigations launched by regulators and state attorneys general have found that most lenders use ‘robo-signers’ when handling foreclosure documents.

In a robo-signing scheme, thousands of foreclosure papers are signed in a day without any legal review. The documents make foreclosures ‘effective immediately.’ In other cases, ‘dual tracking’ was committed. In the process, a lender implements and finalizes a foreclosure even if the law states that a borrower should be given opportunities and time to negotiate terms to avoid foreclosure.

The issue prompted the Senate Banking Committee to conduct a series of hearing about the problem. Regulators, state attorneys general, and bank representatives were summoned for the hearing. Fannie Mae and Freddie Mac were also invited to provide their testimonies.

NAR Home Sales Index Rises in October

The gain in home sales contracts in October was about 18.3% higher than the index in June, which was the record lowest level for the entire decade. NAR started tracking such signed home sale contracts in 2001. The October increase was still 20.5% lower compared to the index in October 2009. The record highest level of the index was in May 2006, which came prior to the historic collapse of the national housing market.

The increase came somehow as a surprise. Most economists had expected a decline in such home contract agreements. They underlined the numerous and grievous problems that the housing industry has been facing.

It should also be noted that last year, more homebuyers got into contracts to buy existing or already occupied homes. That is because at the same month in 2009, more homebuyers rushed to enjoy a buying spree in the market to take advantage of the federal government’s tax credit offers.

          Many homeowners attempting to do a short sale were challenged with the fact that the bank would not give them a full release of liability. All first trust deeds will be protected even when equity was taken out of the house in a refinance. The bill does not offer any protection for second trust deeds. Most homeowners who use subprime lending in the peak of the market had a first and second combination. This law does not protect the homeowner if the lender can prove fraud.
