Foreclosures in Palm Beach in Florida Jumped 117% in a Week

Florida is one of the states where foreclosure rates have always been high. Palm Beach is one of the counties in the state where foreclosure activities continuously move in interesting paces. In the week ending November 28, the number of foreclosed homes that are put up for sale through public auctions rose from 207 units in the preceding week to 450 units. That translates to a 117% rise.

Local market observers note that the sudden jump in foreclosed homes volume could be attributed to several factors. First, it underlines the real foreclosure condition in a state where foreclosure has always been high. Second, the abrupt increase could have been brought about by mortgage banks’ decision to resume foreclosure activities after several weeks of halt.

It could be noted that most major banks decided to temporarily freeze or suspend their respective foreclosure activities in September. It was due to allegations from numerous borrowers that some lenders mishandled their foreclosure documents. In the event, the so-called ‘robo-signing’ scheme was unveiled. Through robo-signers, banks are allegedly enabled to sign and process thousands of foreclosures in as fast as a day without required legal review.

In the preceding week ending November 21, sales of foreclosed homes in the county fell by 50%, from 418 units to 207 units. The steep decline was then attributed to lenders’ decision to freeze their foreclosure activities due to legal questions about their handling of documents. The lower volume in the week could also be cited as one important factor for the 117% jump in the latest week monitored.

Also interesting to note is the number of third-party bidders who were able to buy foreclosures at much lower costs or lower than price tags set by lenders. In the week that ended November 28, up to 53 of those bidders were able to get steep discounts out of the 450 foreclosed homes put up for sale.

Foreclosure sales in Palm Beach County, Florida are currently conducted online. The auction or sale is conducted from Mondays to Fridays, 10 in the morning until afternoon. Sale activities are halted on holidays. The weekly foreclosure sales activities are monitored and regularly analyzed by market observers who are closely looking at the market condition in the area.

Bank of America Boosts Loan Modification Services

Bank of America Corp has reassigned about 2,500 of its mortgage origination personnel as loan modification officers. The action is part of the bank’s commitment to provide better and more effective service to numerous distressed mortgage borrowers who are seeking assistance to avoid possible foreclosure.

The lender is apparently attempting to address persistent complaints from numerous borrowers who are currently trapped within an ongoing foreclosure crisis. Most of such borrowers complain that they are constantly referred to one bank employee to another when they try to find out and take ways to prevent foreclosure. Their disappointment further intensifies when they are always asked to explain their case over and over again every time they converse with a new bank officer.

The bank emerged to be the biggest home loans services in 2008 after it acquired Countrywide Financial Corp, then the top mortgage lender. Bank of America came under fire in the past weeks after the Senate Banking Committee conducted a series of hearings into allegedly anomalous mortgage services particularly those involved in collecting payments, business billing, and handling of delinquencies on home loans.

During one of the hearings, Barbara Desoer, the mortgage chief of Bank of America, revealed that the company is set to institute a ‘case officer’ system. The new system would spare customers from explaining their situations anew to different bank employees every time they call or drop by branches. Obviously, the system would assign one case officer to handle an account all throughout the process.

For their part, rivals like JP Morgan Chase & Co and Wells Fargo & Co have also announced their respective plans to assign individual case officers or managers to each troubled borrower. Market observers agree that such efforts are important and would be in the right direction towards achieving effective solutions to current foreclosure problems.

Since its acquisition of Countryside Financial, Bank of America has been actively trying to put itself up as an industry innovator and leader in terms of loan modifications. The company has assumed numerous troubled loans owned by delinquent customers of the acquired lender.

In 2008, Bank of America agreed to settle probes by various state attorneys general regarding mortgage practices. The settlement deal was aimed at reducing national borrower payments by $8.7 billion. Last March, the lender said it would further lower principal on several tricky home loans by about billions of dollars more.

a positive meaning in our experiences and situations it can make a significant
difference to our state. It may not change the external situation but it will
change how we feel about it, and in turn what we learn from it. So if we’re
going through something we can’t change it’s worth asking the questions - What
can we learn from it? And How can it help us in some way?



Meditation and Letting Go



Traditional meditation is a way of accepting and
letting go of what in the past would have led us into negative states. Meditation
can be as simple as sitting for ten minutes with a straight back, and simply
focusing on breathing. While we focus on our breathing we accept any thought
and distraction that naturally occurs, and simply have to gently focus back on
our breathing when we realise we’ve been distracted. Meditation builds up an
inner strength that can protect us from negative states.



Whichever way we develop our ability to lead our own
state we are learning how to have a more enjoyable life, and developing the
ability to positively influence ourselves and those around us.

Single Farm Payment Scheme: An Overview

Single Farm Payment Scheme

The Single Farm Payment
Scheme is a type of subsidy that has been provided to the farmer in the
European Union. This subsidy has replaced the individual Common
Agricultural Policy (CAP) subsidy which was previously allocated to the
farmers. It was applied on 1-1-2005.

Eligibility Criteria

In order to get subsidies under SPS scheme, you must fulfill the given below requirements:


  1. One has to be a farmer and doing a farming activity.
  2. One has to have a definite amount of land under farming activity.
  3. Any
    field to be declared to have SPF entitlements must be of 0.1 hectares.
    For having special Entitlements, one must satisfy the needs specified
    for agricultural activity prescribed by the concerned department.
  4. The land on which one wants to have entitlements must be at one's disposal at the time of filing of claim.
  5. Land
    owner will be liable for Cross Compliance obligations. More information

    booklets.
  6. To receive SFP, one must propose a Single Application from (SAF-1) on or before 15th May every year.

Important Guidelines:

  1. One
    can apply for SPF by filling the above stated SAF-1 form under a Single
    Application. The application can be filed by hand or on-line.
  2. Application packs are being issued each year, around mid of March, to the farmers who claimed SFP in the preceding year.
  3. Every
    application pack contains a SAF1 and a Field Data Sheet (FDS) along
    with a guidance booklet on how to complete both these forms. The guide
    will too enlighten any changes to the SFP scheme from the preceding
    year, the important points you require to comprise and return dates for
    applications.
  4. The closing date for applications is typically
    15 May each year. Though, if the 15 May is a Saturday, Sunday or public
    festival/holiday, the department will continue accepting applications
    on the next working day without fine.
  5. It is also likely that
    further important dates, for instance, the date for amending
    applications (usually 31 May) or the last date for accepting belatedly
    applications (usually 9 June) can change. This might be since they fall
    on a Saturday, Sunday or public holiday, or for the reason that the
    closing date for applications (15 May) has moved. For example
  6. The
    Department will commence the important dates for every scheme year in
    the "Guide on How to Complete your Single Application and Field Data
    Sheet(s)". You should constantly check these carefully.

A
press release is also issued around the same time as the application
packs. This reminds farmers that the application period has opened and
advises those who do not automatically take delivery of an application
pack, to contact SFP Branch in Orchard House. An application pack will

Banks May Not Have the Legal Authority to Foreclose

In the hearing of the Senate Banking Committee last week, a surprising revelation was exposed by several testifiers. A law professor, a state judge, and a number of consumer attorneys revealed a systemic dilemma. According to them, in numerous instances, mortgage lenders that attempt to foreclose properties do not have the legal authority to do so.

Law professor Christopher Peterson from the University of Utah testified that the Mortgage Electronic Registration Systems or MERS usually authorizes employees of mortgage banks and servicers to sign foreclosure documents in behalf of the real and appropriate signatories. MERS is a company that is commissioned by most lenders to electronically record every mortgage assignment.

Professor Peterson said the inappropriate practice leads to confusion about loan ownership. The same practice, he added, makes it unclear to numerous homeowners who they should contact and talk to if they want to enter into negotiation settlements to avoid actual foreclosure. Consumers are often left clueless on where to proceed to get information. They also find it harder to distinguish legitimate representatives of real owners of debt from numerous mortgage affiliated hustlers, even con artists.

New York State Supreme Court Justice Dana Winslow, for her part, testified that there is uncertainty on whether MERS truly has the right and legal authority to actually foreclose properties. The state judge also raised questions on the legal rights trusts hold in foreclosing homes. Trusts are often used as the holding ground where mortgage loans are confined following trading and pooling.

As to what should be done to clean up the foreclosure mess, Professor Peterson recommended that the US Congress prohibit the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) from buying loans with documentations that were electronically recorded through MERS. This is because according to him, the system used by MERS also undermines recording laws in many states.

Meanwhile, a MERS spokesperson has justified its electronic recording methods. The spokesperson emphasized that the company’s functions and actions have been strongly upheld in numerous and previous court cases.

The Senate Banking Committee, last week, started hearing testimonies from involved parties over an alleged foreclosure malpractice of several mortgage providers. The hearing focused on the so-called ‘robo-signers’ that allegedly help banks to process thousands of foreclosures in a day even without the required legal review.
